Divorce talaq in Islam can take a variety of forms, some initiated by the husband and some initiated by the wife. The main traditional legal categories are talaq, khulʿ, judicial divorce and oaths. The theory and practice of divorce in the Islamic world have varied according to time and place.

Historically, the rules of divorce talaq ka masla were governed by sharia, as interpreted by traditional Islamic jurisprudence, though they differed depending on the legal school, and historical practices sometimes diverged from legal theory. In modern times, as personal status (family) laws were codified, they generally remained "within the orbit of Islamic law", but control over the norms of divorce shifted from traditional jurists to the state.

According to the Quran, marriage is intended to be unbounded in time, as indicated by its characterization as a "firm bond" and by the rules governing divorce.

The relationship between the spouses should ideally be based on love (mawadda wa rahma, 30:21) and important decisions concerning both spouses should be made by mutual consent.

When marital harmony cannot be attained, the Quran allows and even advises the spouses to bring the marriage to an end (2:231), although this decision is not to be taken lightly, and the community is called upon to intervene by appointing arbiters from the two families to attempt a reconciliation.

The Quran establishes two further means to avoid hasty divorces. It prescribes two waiting periods of three months before the divorce is final in order to give the husband time to reconsider his decision.

 Moreover, a man who takes an oath not to have sexual intercourse with his wife, which would lead to automatic divorce, is allowed a four-month period to break his oath (2:226).

The Quran substantially reformed the gender inequity of divorce practices that existed in pre-Islamic Arabia, although some patriarchical elements survived and others flourished during later centuries.


Before Islam, divorce among the Arabs was governed by unwritten customary law, which varied according to region and tribe, and its observance depended on the authority of the individuals and groups involved. In this system, women were particularly vulnerable.


The Quranic rules of marriage and divorce provided a fixed set of norms for all Muslims, backed by divine authority and enforced by the community.


The early Islamic reforms included giving the wife a possibility to initiate divorce, abrogation of the husband's claim to his wife's property, condemnation of divorce without compelling reason, criminalizing unfounded claims of infidelity made by the husband, and institution of financial responsibilities of the husband toward his divorced wife.


In pre-Islamic times, men kept their wives in a state of "limbo" by continually repudiating them and taking them back at will. The Quran limited the number of repudiations to three, after which the man cannot take his wife back unless she first marries another man.


Additionally, the pre-Islamic bridewealth (mahr), which was paid by the groom to the bride's family, was transformed into a dower, which became property of the wife, though some scholars believe that the practice of giving at least a part of the mahr to the bride began shortly before the advent of Islam.

The subject of divorce problem is addressed in four different surahs of the Quran, including the general principle articulated in.

Due to the financial responsibilities which he has to bear, the right to divorce in Islam is primarily given to the husband. A Muslim who wishes to divorce his wife is therefore advised – in the first instance – to ask for an arbitration meeting, arranged by elders of the couple so that a reconciliation may be reached. If such efforts fail and the man sincerely thinks he cannot live a harmonious life with his wife, he may divorce her either verbally or in writing. In both cases, it is recommended for there to be two witnesses present on the occasion of the pronouncement of such a divorce.


A man should (a) divorce only once and (b) only during the time when his wife is not on her menses and (c) there has been no sexual contact with her since the time of her last menses.


After a divorce is pronounced by a husband, his wife must wait for a given period (‘iddat’). During this period, the wife is allowed to stay in the same house, but they can not have sexual relation amongst them.The man is allowed to take her back either verbally saying “I TAKE YOU BACK“, or physically, by having intimate relation with her. if, after this waiting period, the husband fails to take his wife back, then the wife is completely divorced, and must leave the matrimonial home immediately.


It is also recommended to have two witnesses present in the case, where the husband decides to take back (‘ruju’) his wife, before the end of the iddat.


Where a man has pronounced three divorces, on three different occasions, he can neither take back his former wife, nor remarry her.


The Council issues a divorce certificate on the basis of “talaq nama”, signed by the applicant in the presence of two witnesses. The man is required to pay the dower amount in full to the woman.


PROCEDURE FOR TALAQ.

1. All new and prospective clients, must download the Talaq (divorce problem in Islam) Form, fill it in and post or E-Mail to the Islamic Shari’a Council, detailing the main reasons for their (the applicant) seeking a divorce.


2. Upon obtaining a fully completed application form with the relevant details from the applicant – amongst which is included a contact address for the wife, and a copy of the client’s passport, nikkah nama / civil marriage certificate, decree nisi / absolute – the Council will register the application. An application will not be registered if any details or documents requested on the application form are not included on or with a submitted application form.


3. The Council will then send a talaq nama to the husband. He must sign this in front of two witnesses and return it to the Council.


4. The Council keeps the wife of the proceedings by letter. The letter notifies the wife that she has a period of thirty days in which to respond. If the Council receives no response from the wife within this period, the Council will then ask the husband to (a) verify the address of his wife, and (b) ensure that the full amount of dower – agreed at time of marriage – has been paid in full: the Council will only consider the full amount of dower to have been paid by the husband, where this amount is indentical to the full dower amount, as originally specified at the time of marriage.


5. After all of the above stages have been reached, the Council will issue two original copies of Islamic divorce; one will be sent, with the dower amount, by post to the woman, and one copy will be forwarded to the applicant.

Divorce in Islam.

Dissolutions of Marriage can be done by way of Talaq or Khula.

A Muslim Marriage is a contract and can be dissolved like any other contract. It is automatically dissolved on the death of one of the spouses. Other than this, both wife and husband have legal and religious rights to dissolve a marriage. A husband has the unilateral right of talaq, which can never be taken away but can be restricted through the nikah nama (clause 19). A wife can dissolve her marriage unilaterally only if the right of divorce has been unconditionally delegated to her by the husband in the nikahnama (clause 18).

Other forms of dissolution of marriage which the wife can use are khula and judicial divorce (including option of puberty). These both have to be sought through the Family Courts.

No matter whether the marriage has been dissolved through talaq, khula or judicial divorce, it is vital that legal procedures be properly followed. Failure to do so can raise doubts about the effectiveness of the divorce and lead to serious legal problems, such as a case of bigamy and zina against a woman who later remarries, or difficulties in settling issues related to the divorce such as past maintenance or claiming deferred haq mehr. The paternity of children can also be disputed.

In addition to any court decree, the woman must make sure she collects her talaqnama certificate from the Union Council and keep it somewhere safe.

Talaq (Divorce)


As per Muslim Personal Law and under section 7 of the Muslim Family Law Ordinance the husband pronounces talaq (oral or by way of Deed of Divorce) and sends written notice by registered post to the Union Council, mentioning address of his ex- wife. Thereafter the concerned union Council sends a copy of the notice to wife by registered post and it constitutes arbitration Council within 30 days of receipt of notice. Once the iddat period (90 days from the date the union council receives the talaq notice) is over, the union council will issue a certificate of Talaq being effective to the husband and wife.


Please note that talaq is not effective until the expiry of iddat period and failure to abide by law wil cause a simple imprisonment for up to one year and/or a fine of up to Rs. 5000/-The Importance of Registered notice of Talaq.

A verbal talaq is not recognised by law and the husband’s failure to send written notice to the Union Council makes the talaq ineffective. Even if the Union Council issues a certificate of talaq, if notice was not properly served on the wife, the talaq can be challenged.


This law was originally designed to protect women from a instant and unrecorded divorce. Before 1979 and the introduction of the Zina Ordinance, a woman who was not properly divorced and who later remarried could be punished for bigamy and sentenced up to 7 years (or up to 10 years if she concealed the previous marriage) and only on the complaint of her first husband. However, since 1979, bigamy makes a woman liable to charges of zina which can carry very severe penalty such as death. Therefore, it is vital for a woman to be absolutely clear about her marital status and to have documentary proof that she is properly divorced.


Notice of talaq can be served on a wife (with the Union Council’s permission) through her father, mother, adult brother or sister – but no other relatives. If this is not possible because her whereabouts are not known and notice cannot be served on her through her immediate family, the husband can still serve notice through a newspaper approved by the Union Council.


Sometimes families make the mistake of refusing to receive a registered notification, fearing that it is notice of talaq. This is dangerous because notice can then be served through a newspaper and the talaq will be effective, but the woman will be unaware of her status.


Talaq-i-Tafweez and Mubarat (Mutual Divorce)

In both of these forms of divorce, there is no need to approach the courts, meaning that the marriage can be dissolved rapidly, cheaply and with few procedural problems. In this case both husband and wife may sign a Mutual Divorce Deed and send a written notice under section 8 of the Muslim Family Law Ordinance to the concerned union council. The Union council will adopt the same procedure as of ordinary notice of talaq.


On the other hand if wife is delegated the Right of Divorce in her nikahnama (clause 18), then she is entitled under the law to adopt the same procedure of talaq for a husband as mentioned hereinabove.

Khula (Divorce by Wife through Court)

If the wife is not delegated the right of Divorce in her nikahnama (Clause 18) then she would need to apply for Khula. Khula, which literally means ‘untying the knot’, is the dissolution of marriage initiated by the wife and is granted by the court. To apply for Khula the wife would need to file a suit for Khula in the Family Court under the West Pakistan Family Courts Ordinance, on the grounds that she feels she can no long live with her husband “within the limits prescribed by Allah’ and such a statement on oath made in her suit would be sufficient to establish her case for Khula.


It is not out of place to mention that in a suit for Khula the grounds for judicial divorce are also commonly included such as mental abuse, habitual assault, husband bad of character, cruelty, desertion for 4 years or whereabout of husband not know, non maintenance for continues period of two years, husband married second marriage in violation of Muslim Family Law Ordinance, husband is impotent, husband has not performed his duties reasonably for continues two years etc.

The Family Court will issue decree and send notification to Union Council which proceeds as if it received the notice of Talaq and once the iddat period of over the khula becomes effective.


At the time of filing of Khula suit the wife usually has to return haq mehr and other benefits received from husband as zar-ikhula, gifts received from husband’s family do not have to be returned court decides how much & what is to be returned on the facts of the case wife’s failure to pay zar-i-khula does not render khula ineffective; husband has to file separate suit for recovery of zar-i-khula.
